Hey Kidz:
A certain Reluctant Cannonball informs us that Colin Moulding was in New York
City earlier this week to give testimony in the US District Court as a
co-plaintiff in the case of TEEVEE TOONS, INC. et al., Plaintiffs, -v-
MP3.COM, INC., Defendant.
The judge in the case, Jed S. Rakoff, found in favor of TVT, using stern
language in his opinion: "[MP3.com's] arguments are so unpersuasive on their
face as to warrant but little discussion here."
(Which, come to think of it, characterizes pretty much *all* the defenses
I've heard in favor of a system that gives away other peoples' work for free
without their permission.)
As you may recall, MP3.com settled a suit brought by a consortium of the
major labels ("UMG Recordings vs. MP3.com") earlier this month. According to
the Cannonball, MP3.com did *not* settle with the independent TVT -- his
succinct characterization was that "MP3 said 'fuck you!' to Steve Gottlieb."
Judge Rakoff (unfortunate name, that, in these graft-prone times!) has
brought down the terrible swift sword of justice on the miscreants. If you'd

The Cannonball commented (quite heatedly, I might add), "I'm all for using
the Internet to distribute music--nothing wrong with that. But after twenty
years, I'm only *just now* starting to get a pay packet, and they're trying
to take even *that* away from me!"
So now you know how he feels about it. Please take this into account when
exercising your inalienable right to Free Stuff.
In other Cannonball news, Monday he took delivery on a spanking-new Macintosh
G4 to replace the Atari in the Shed. He's quite intimidated by the version of
Cubase VST he bought to replace his old MIDI sequencing software, but he
brightened when he was congratulated on his excellent taste in computers.
Like all the *best* geniuses, Our Brainiac, too, Thinks Different.
The Idea Records web site is being put together by Kabel New Media, a German
web design firm with offices all over Europe. It will contain an "XTC
Boutique" where you can buy XTC merch and recordings, plus scanned pages of
old notebooks, a photo gallery, and an area where you can listen to music
online--streamed, presumably. Its primary purpose at the moment will be to
promote the "Fuzzy Warbles" releases. I'm betting Macromedia Flash is
involved.
On the "Coat of Many Cupboards" front, they are still searching their
personal archives for old demos, listening to ancient cassettes and so forth.
Their arrangement with Virgin is that XTC will pack off anything they
find--down to the lowliest mumbled Dictaphone ideas--to Virgin. (Andy said
he'd just yesterday discovered an embryonic version of "Senses Working
Overtime" that had been hummed into a portable cassette.) Virgin will
"cherrypick" the best 15 of anything they get for the demos disk of the Many
Cupboards set. Absolutely everything else will revert to XTC in perpetuity,
for ever and ever until death do them part. This body of music will become
"Fuzzy Warbles."
Thus Endeth the Strike.
A droll anecdote about being hit in the face by a mud-filled brassiere while
onstage in Switzerland was recounted. This was followed by a list of objects
flung at the stage in France, far and away the most object-flinging-prone
country XTC ever toured:
- wine bottles (full and empty)
- cigarettes (lit and unlit)
- broken glass
- books (titles forgotten, unfortunately)
- clothing
- people (primitive crowd-surfing)
- biscuits
This last item evinced an impression of a French guy departing for the XTC
gig, and going through his checklist of flinging supplies: "Eh, bien, I've
got zis volume of Sartre, oui, and my extra sweater, tres bon -- Ah! I 'ave
forgotten ze chocolate digestives! Zut alors!"
Paul McCartney had a much greater musical influence on him than John Lennon.
(Duh.) He *loves* Zappa. The pet question I've always wanted to ask him ("How
much Jethro Tull did you listen to as a youngster?"), spurred an anecdote
about Martin Vincent, the founder of Stray Blues and a total Tull fanatic,
who "borrowed" large portions of Partridge's record collection and sold it to
second-hand shops. Andy recently bought a copy of "Living in the Past" and
likes it quite a lot, and agrees that Tull must have rubbed off more than he
remembered. (Listen to "The Wheel and the Maypole" again, and tell me it
isn't crying out for a one-legged flute solo in the middle.)

Please, read before beginning your flame attack. Now, I may not know every
intimate detail of Andy's relationship with his (ex)wife, but I've read
Song Stories and listened to every one of his songs, so when I finally got
a chance to see the video for The Mayor of Simpleton again (on
Launch.com), I had a fresh new look at it. See, in the video, the lads
from Swindon are all dressed up funny in different costumes and a very
beautiful woman in a leather body suit is chasing Andy around, pushing,
shoving, hanging off of him. Now, in psychedelic text, each of the people
in the videos is given a name "Barry as the Fish", etc. Andy, Dave and
Colin all get cute names, as do the goldfish and dog in the video, but the
woman remains this nameless figure. Did I just miss it? I don't think I
did, as I couldn't keep my eyes off her, but the whole thing just seemed
to me to place little value as a person on the nameless beautiful woman in
the video, as if she's so unimportant. Anyone else see this, or do I just
read too much into these things?

So we talked for a few minutes, and then I heard some strange music coming out of Dave's headphones. He wasn't wearing them, but the music was still playing. I was immediately reminded of the film "Diva". So I asked Dave what he was listening to. He said it was some "psychedelic" music, Apples In Stereo. Well, I've heard of them, so I asked Dave if he listened to XTC. His eyes widened. I said I'd heard that Robert Schneider of Apples In Stereo was working with Andy Partridge of XTC. Dave said a few things about XTC and Apples In Stereo that he can repeat in this forum if he feels like it. So then I asked Dave if he surfed the web. He said he did, and that he was on Chalkhills. Ah ha! So I said, "I run Chalkhills. I'm John Relph." You should have seen his face! My wife interjects that Dave started talking about three times faster at this point. A coincidence indeed. On a related note did anyone else here see the episode of the Powerpuff Girls inspired by the Beatles? It was very very funny and deserves a place right next to Spinal Tap and the Rutles. I've ordered Homegrown. I was reluctant to given the price but I have the feeling we're not going to see it over here any time soon. I was also reluctant because I haven't listened to Homespun in quite some time while I have listened to Apple Venus Volume One (which I have to agree is a better album than Wasp Star. Wasp Star has many great moments on it but it doesn't hold together as well as Apple Venus. It's kind of like comparing Abbey Road to Let It Be. Wasp Star is exactly what it appears to be--the songs that didn't fit on Apple Venus. Anyhow, I suppose Homegrown will give me my Xtc fix while I wait for the remasters. Any word on whether we'll see any DVD audio editions for their best albums? Is Geffen going to reissue them here as well or is the contract with Geffen up? I imagine Virgin would probably issues them here if the contract with Geffen expired. One thing I have to agree with Vee about are the digipaks. Hate them. If you're going to do it either go for the gusto (a replica of the album in a cardboard sleeve with rice paper insert) or do the jewel box. I'd prefer the later only because they can take a lot more abuse. Now I know that Andy has been saying it was intended as a two CD set originally, etc. but WS just doesn't gel when compared to AV1. Although the finest moments on WS are every bit the equal of AV1 (Playground, Standing in for Joe, Stupidly Happy and I'm the Man who murdered love, etc.). I return for for a slight missive, for those who don't remember me
don't worry I have trouble myself sometimes.. :) First off if you like Robyn
Hitchcock at all you will enjoy Storefront Hitchcock..It's very intimate,
well filmed, and filled with his lovely wit.
As for Zappa I don't agree on starting a newbie on Overnite Sensation,
for I know many a person who claimed to dislike the man just because of the
silliness and the filthiness contained in the classic Dinah-Moe-Hum...I for
one love it. It was my Dad who showed me the record in High School and told
me to read the lyrics..(no he's quite normal really) But it was one strange
night of record spinning that led me to Frank..and yes the record that I
picked out of the dusty boxes of archaic sounds machines in my attic was
We're only in it for the Money...and what a pleasant surprise! It was like
walking into an alternate reality where you could look at Rock music from
the outside in and discover for yourself why you love it so much...it
pleasantly warped me from then on and now if my music isn't a little "zany"
or is too "straight" then I have trouble really loving it. So my vote is
start there, and then move to his less Anarchic LP's of the Seventies..(save
Uncle Meat as a treat for later)
One more thought...I saw the Soft Boys this week in Boston and must say that
it was one of the best and best feeling "Rock" shows I've seen to in a long
time. Now they haven't toured since 1980..which you might think is a long
time ago. Yes it is, but can you think of another band who hasn't toured
since around that year?? Yup our friends XTC! Strange to think a band that
had been apart for 21 years could be so naturally good, but if they can do
so could XTC...now you all realize i'm speaking theoretically here...I
wouldn't force Andy out of his shed unless music failed to issue from
it..but just a passing fancy...ahhhh

Well...he now loves the album. He's gone back and gotten Apple Venus (sadly off Napster) and loves it too. I was alone (husband had to work), so I joined them for a drink before the show. So they're putting Dear God on the reissue of Skylarking, but at least Mermaid Smiled is in the right place, and as they put it at the end, well I can just programme it off the cd :-) OK I'll buy it. Highly recommended - Neil Finn's "One-Nil". I'll say just one thing about it (stop worrying Adrian) - it maybe something of a surprise - and yes the nil funn site is truly awe inspiring.
